The IDEA reassessments state that “the reassessment of students with disabilities must take place every 3 years, unless the parents and the public body agree that a reassessment is not necessary.” § 300.303 (b) (2). However, according to the PARC Consent Decree, students with mental disabilities in Pennsylvania must be reassessed every 2 years and neither the IEP team nor parents can waive reassessment for students with mental disabilities. There are no exceptions. One of the objectives of a reassessment is to determine whether the student still has a disability and needs special education and related services. The reassessment should also help the IEP team decide whether the student is progressing well towards the IEP goals and, if reasonable progress is made, what changes are needed. For a student with a disability who attended a private school and then enrolls in the school district, the school district must determine whether a reassessment is required. . . .
